At Peterson Law, LLP, our attorneys have decades of success at trial. However, if there’s one thing our experience has taught us, it’s that sometimes the biggest successes come when you don’t have to go to court in the first place. That’s why we provide comprehensive pre-litigation services in San Diego and throughout California.
While we are entirely prepared to fight on our clients’ behalf in the courtroom, we find that alternative dispute resolution methods like mediation often lead to better outcomes. We can help you find the best method to address your legal issues and represent you at the negotiation table with just as much expertise as in the courtroom. Contact our San Diego pre-litigation law firm to learn how we can help you handle disputes without the need to go to court.
What Is Alternative Dispute Resolution (ADR) and Why Is It Valuable?
Alternative Dispute Resolution (ADR) refers to a range of processes and techniques used to resolve disputes outside the traditional judicial process of litigation in court. ADR is designed to be an alternative to resolving disputes through lawsuits and is known for being generally more flexible, time-efficient, and cost-effective than traditional court proceedings. The most common forms of ADR include:
- Mediation: A voluntary process where a neutral third-party mediator assists the disputing parties in negotiating a mutually acceptable settlement. The mediator does not decide the case but helps facilitate discussion and resolution. This process is non-binding unless an agreement is reached and formalized.
- Arbitration: Involves a neutral third-party arbitrator (or a panel of arbitrators) who hears the evidence and arguments from the parties involved and then makes a decision. Arbitration can be binding (the decision is final and enforceable like a court judgment) or non-binding (the decision can be appealed to a court).
- Negotiation: A process where the parties involved communicate directly with each other to try and resolve their dispute without the involvement of third parties. It is the most informal form of ADR.
By keeping disputes out of the courtroom, all of these options can help you resolve disputes faster and with less stress. You can keep your dispute confidential, avoid damaging relationships through adversarial litigation, and retain more control over the outcome compared to litigation.
Of course, not every situation is the right fit for ADR techniques. If the other party isn’t willing to negotiate, attempting mediation and negotiation may not work. We can help you determine if that’s the case and move directly to litigation to resolve your dispute without wasting time.
